City attorney reports settlement in Baniagua case; acting city clerk Talisha Lopez approved as permanent with contract to follow

The San Bernardino City Council reported two actions taken in closed session on Sept. 17: the council voted to settle Ricardo Baniagua v. City and voted to appoint the current acting city clerk, Talisha Lopez, as the permanent city clerk, the city attorney said.
The city attorney told the council the settlement of Ricardo Baniagua v. City passed on a motion by Council Member Charette, seconded by Council Member Sanchez, and it passed unanimously.
On a separate reportable action, the council voted to make Talisha Lopez the permanent city clerk. That motion was made by Council Member Sanchez and seconded by Council Member Charette; it passed by a vote of 6 to 2, with Council Member Ortiz and Mayor Helen Tran recorded in opposition. The city attorney clarified during open session that final employment terms will be the subject of a contract brought back to the council at a future open meeting.
Council members offered public congratulations to Lopez after the report and staff confirmed the appointment will be memorialized later in an open‑session contract vote.
