Commission approves amended Reserve at Swains Creek development agreement with lower Phase 1 density

The Kane County Commission on Sept. 16 approved an amendment to the development agreement for the Reserve at Swains Creek project, altering the Phase 1 layout to reduce the number of lots and increase open space.
Tom (last name not specified), representing the project, told the commission the amendment moves an originally planned later phase to Phase 1 and reduces lots in the meadow area from 14 to 9, increasing average lot size in Phase 1 from about 2.4 acres per lot to about 3.8 acres per lot. He said open space in the phase increases from roughly 11.2 acres to 12.8 acres (raising open-space share from about 33% to nearly 38%). The revised plan also reduces the number of residential lots near the helipad/hangar meadow to four in that area, compared with a larger number originally proposed.
Commission discussion noted the change will not increase the total number of lots across all phases; the developer said overall lot counts and minimum lot-size requirements approved previously remain in effect, but phase sequencing and lot locations changed. Planning staff and the county attorney confirmed no new public hearing was required under current state law for the requested amendment.
Commissioners voted on the amendment. Commissioner Cabea voted yes and Commissioner Myers (chair) voted yes; Commissioner Brown recorded a nay and said he opposed the project generally (specifically the helipad component) though he acknowledged improvements in open-space area. The motion passed 2–1.
