The Town of Lakeville Rent Control Board on June 14 approved a petition from Twin Coach Estates Homeowners Association to raise lot rents by $20 per month per unit and made the increase retroactive to Jan. 1.
The action followed a public hearing in which Joanne Core, president of Twin Coach Estates Homeowners Association, explained the membership had voted at a September 2017 meeting to approve the increase as part of its 2018 budget. “I’m Joanne Core. I’m the president of the homeowners association at 8 Haskell Circle,” Core said while testifying and was sworn in to speak during the hearing.
Board members reviewed financial statements and budget documents provided by the association. A board member who identified herself as a certified public accountant and who reviewed the association’s records told the board, “I am a CPA, so this is, like, right at home,” and cautioned the association about long-term debt service and the likelihood of needing future increases if conditions change.
Why it matters: the board serves as the local approving authority for rent increases at mobile home parks under the town’s rules on mobile home park accommodations, rents and evictions and relevant state regulations cited at the hearing. By approving the petition and making the increase retroactive to Jan. 1, the board validated a membership-approved budget change that the homeowners association said took effect earlier in the year but was delayed in formal filing with the town.
Details and board discussion - Petition and timing: Twin Coach Estates submitted an owner petition for a rent adjustment filed with the town on May 15, 2018, the board said. Association representatives told the board the membership voted on the budget and rent increase in September 2017 and intended the increase to take effect Jan. 1; the application process and an audit delayed formal filing.
- Financials reviewed: Board members examined three years of financial statements, budget documents and a profit-and-loss trial balance the association provided. The association reported using reserve funds to cover planned paving and tree work estimated at about $75,000. The board member-CPA highlighted that roughly 35 percent of monthly dues were going to interest on the association’s loan and noted the association carries approximately $1,500,000 of mortgage debt at an interest rate of about 6.25 percent, with a balloon payment due in roughly six years.
- Practical consequences: The CPA-style reviewer warned a future revisit of rents could be necessary before the balloon payment comes due, saying the association may face refinancing pressures and that rising interest rates could increase debt service. The board noted the town’s application and documentation requirements are onerous but necessary for its review.
Board action After public testimony and board discussion, a motion to approve the $20-per-month increase and to make the approval retroactive to Jan. 1 passed by voice vote. The board did not record individual members’ roll-call votes in the transcript; the chair called for ayes and announced the motion carried.
Votes at a glance - Reorganization: Motion to appoint Mitzi as chair of the Rent Control Board (approved by voice vote; three board members voting in favor). - Twin Coach Estates rent increase: Motion to approve a $20 per month per unit increase, retroactive to Jan. 1 (approved by voice vote). - Minutes: Motion to approve meeting minutes dated Dec. 21, 2015 (approved; one board member abstained). - Adjournment: Motion to adjourn (approved by voice vote).
What the record shows and next steps The board’s approval formalizes the rent adjustment that Twin Coach Estates’ membership said it had already implemented earlier in the year. The association and the board discussed the town’s paperwork requirements; the association asked whether simpler submission of its membership-approved budget and profit-and-loss statements would suffice. Board members responded that the town requires the specific forms and supporting documentation for any rent adjustment review.
The board did not set any additional conditions or require supplemental reports as part of the approval. The association will continue to manage the park under its homeowners association governance and existing mortgage terms.
