Commission approves Sinclair sign permit after appeal-authority variances and color compromise

The Tocqueville Planning Commission on Sept. 10 approved a sign permit for the Sinclair-branded fueling facility at the Sapp Brothers travel center, adopting the findings of the city's appeal authority and the variances he granted.

Lynn Cresswell, the city's appeal authority, reviewed supplemental materials from the applicant and Clovis Signs and concluded variances were warranted for canopy signage and for allowing multiple signs where several businesses operate on the single site. Cresswell said many of the smaller panels over fueling pumps qualified as code exemptions (service-station signs under 8 square feet) and therefore did not need individual permits.

Cresswell also described a negotiated color solution: rather than a full white background, the applicant agreed to a blended, neutral background that retains Sinclair's traditional green for branding elements but avoids a stark white field that the code discourages. The administrative decision noted the city's general plan encourages flexible zoning tools to support economic activity and wayfinding along travel corridors.

Commissioners asked whether approving the permit would set a binding precedent; staff and the appeal authority said the variance process is case‑by‑case, and the appeal authority's role is separate from the planning commission. The commission moved to approve the sign permit as drafted, adopting the appeal authority's September 2 decision and permit language. The motion passed by voice vote.

The decision includes allowances for the automobile fueling canopy and RV fueling signs (variance granted for square footage), recognition that the small service‑station panels are exempt, and inclusion of Sinclair's name and logos on the previously approved monument sign at the site entrance.
