Planning commission denies conditional use permit after applicant withdraws signature for 661 West 7250 South

The Midvale City Planning Commission on a voice/roll-call vote denied a conditional use permit for an automotive repair and accessory business proposed at 661 West 7250 South after staff told commissioners the application was no longer complete.

Planning staff said the landlord withdrew a signature from the permit application and the applicant told staff they wanted the application withdrawn. "The applicant has verbally expressed that they want their application withdrawn. We've not confirmed that in writing yet," said Johnny, planning staff, adding he had a printed email from the landlord.

Because the application lacked required signatures, staff recommended denial. The commission held a public hearing, heard no public comment and then voted to deny the application. The motion to deny was adopted by roll call: Chair Anderson, Vice Chair Erickson, Commissioner Snow, Commissioner Liedtke and Commissioner Kasperian all voted yes.

The denial was procedural: commissioners did not debate the merits of the proposed vehicle-repair use because staff reported the application was effectively withdrawn and incomplete. The record shows the denial was linked to missing applicant/landlord authorization rather than a zoning determination on noise, traffic or environmental impacts.

The commission closed the public hearing after receiving no public testimony. The file will reflect the commission's denial recommendation; any future submittal would need to include complete signatures and supporting materials.
