Assembly convenes executive session on Allutnik Heritage Foundation property-tax appeal

The Kodiak Island Borough Assembly on Sept. 11 convened to an executive session to discuss pending litigation after the Allutnik Heritage Foundation filed an appeal to the Alaska Superior Court.
Assembly member Jared moved to convene the executive session under KIBC 2.3.0.03(f)(1)(a) to discuss the litigation and to provide direction to the borough manager; the motion was seconded and passed on a roll-call vote. Amy Williams, the borough manager, told the assembly that when the assembly had previously sat as the board of equalization it found in favor of the assessor and denied the foundation’s appeal; the Allutnik Heritage Foundation subsequently filed an appeal to the superior court.
The manager said the foundation filed the appeal in a manner the borough did not expect and asked for the executive session so staff and the assessor, Sima Groot, could brief the assembly and receive direction. The assembly voted to invite the mayor, assembly members, borough attorney, manager, assessor and borough clerk into the executive session. The assembly took a five-minute recess before entering the executive session.
No substantive content of the executive session was disclosed in the public record at the special meeting.
