The Sarasota City Nuisance Abatement Board on Sept. 18 accepted a stipulation in case number 25-01 in which the respondents agreed the property at 165620 Ninth Street met the city's nuisance code criteria. The board voted unanimously to accept the stipulation.
The stipulation, as described by City Attorney Attorney Fernandez, concedes the substantive elements of the nuisance case — "they're stipulating to the substantive case, to the to the nuisance, to the case in chief," — and leaves only the penalty or cost phase for a later hearing. Attorney Fernandez told the board an order would be prepared for the chair to sign at the conclusion of the meeting.
The stipulation was presented after the city attorney reported that respondents had retained private counsel, attorney Keith DeBose, and that counsel had communicated with the city to resolve liability. "We have entered into a stipulation ... and agreed that we'll come back at a later date before the board regarding the cost or penalty phase," Attorney Fernandez said.
Board members discussed that the stipulation resolves the first part of the two-part process under the city code: first, determining whether a nuisance occurred; second, determining costs, fines, or nonmonetary conditions. The board noted that any testimony from Sarasota Police Department (SPD) or other witnesses about subsequent events would be taken at the later hearing to inform the sanctions phase.
A motion to accept the stipulation was made and seconded; the board recorded a unanimous vote in favor. The board asked that a stipulation order be circulated for review and that the chair execute the certification of the order once finalized.
The board will schedule a follow-up hearing to consider penalties, costs and any recommended nonmonetary conditions. SPD will coordinate with counsel and the city's office to set the date and to present evidence at that later hearing.
No fines, costs or other sanctions were imposed at the Sept. 18 meeting; the only action taken was acceptance of the stipulation resolving the liability portion of case 25-01.
The meeting also included routine procedural items earlier in the agenda, including approval of minutes for May 30, 2024 and July 10, 2025, which the board approved unanimously.
