Plat committee adds airport noise disclosure to Oberlin at Camby Village plat

The Indianapolis Plat Committee accepted a request to add an airport-related noise disclosure to the staff report commitments for the Oberlin at Camby Village plat (2025 PLT 057) at its Sept. 10 meeting.

Rick Ellis of Line Engineers, representing Oberlin Development LLC, told the committee that Indianapolis Airport Authority counsel asked that a “special noise disclosure statement” be attached to the plat and that the petitioner agreed. “Indianapolis Airport Authority counsel contacted me and asked to attach a special noise disclosure statement to the plat, which we've agreed to,” Ellis said.

The committee directed staff to add a new Commitment 14 to the staff report and to include the disclosure on the recorded plat. The added language, read into the record by the chair, states in part that residential real estate described by the plat “may experience levels of aircraft noise and other effects that certain individuals may find objectionable” and that purchases of property subject to the plat will be deemed to have knowledge of and acceptance of the noise disclosure and to release the seller and the Indianapolis Airport Authority from related claims.

The request was heard during the expedited portion of the agenda; the committee approved the expedited docket and the addition of the commitment was entered into the record so that the disclosure will appear on the plat prior to recording.
