Board approves separate site construction plan requirement and related fee authority

The Satellite Beach Planning Board approved a code change that creates a separate requirement and fee authority for site construction plans for non‑subdivision projects.
Planning staff said the new section largely mirrors language taken from the subdivision construction plans code (section 3-13) but is tailored to apply to single‑lot or other non‑subdivision development. "What we now require is a is a site plan. The site plan comes in. If you look at the code, there's 2 sections of code. There's site plan and then there's subdivision construction plans," a staff member said. Staff added that the new section pulls and refines the relevant subdivision language so site construction plans can be required and fees charged for engineering review and in‑house review of those plans.
Staff said the change will allow the city to recoup costs for reviews on projects that previously did not require construction plans, citing recent examples of non‑subdivision developments such as the Trident (the old bowling alley property), Inkfish at 600 Jackson Court and Atlantic Storage. "At the same time, we can't charge fees for those site construction plans. So what this does is creates a whole new section and fees that are applicable to it for site construction, for engineering review, for in house review, so that we can recoup some of those fees that we're spending," the staff member said.
Staff also said about 98% of the new language was taken directly from section 3-13 and that items not relevant to non‑subdivision projects (for example, roads) were removed. "I would say 98% of it is taken right out of the out of section 3 13," the staff member said.
A board member moved to approve the amendment and it was seconded. The recorded aye votes included Cindy Kane, Kyle Mamodeau, Jeff Seager and David Delisle; the motion carried. The board also approved the minutes from the June 16 meeting and confirmed the next meeting is scheduled for Oct. 20.
The board and staff said a separate city fee resolution before council on Oct. 1 will set the specific fees tied to the new requirement.
