The Oak Grove City Council on an unnumbered date approved a resolution authorizing a settlement framework with the Minnesota Department of Natural Resources, Rum River Pines LLC and MRTA LLC over the plats of Timbers Hideaway, Rum River Pines and Viking Bluff. The resolution passed on a 5-0 roll call vote.
The resolution, as described to the council by staff member Joseph, directs the city to complete three related agreements: (1) an agreement with the property owner in which the owner will record a restrictive covenant in exchange for the city providing supporting documentation, expedited future land‑use approvals, and a combined $300,000 in assistance from the city and city consultants; (2) a second agreement among city entities to facilitate the city’s portion of that payment; and (3) an amended development agreement with the developer to allow the project to proceed once the settlement is finalized. Joseph said the council is being asked to approve the resolution now but that execution of the settlement document will not occur until the DNR completes its internal sign‑offs and the auxiliary agreements are executed.
Why this matters: the measures are intended to resolve outstanding legal and land‑use disputes tied to three plats that affect future development and city approvals. The payment and the restrictive covenant are central terms described in the staff summary presented to the council.
Council discussion was limited. One council member asked whether the city’s required property review frequency would change from every two years to one year; staff said there was no change on that item. Joseph also told the council the city administrator and city attorney were authorized to approve only minor amendments to the settlement agreement and associated district covenant, and that any major or substantive changes would return to the council for approval.
Action: Council member John West moved to approve the resolution; Mayor Weston seconded. The recorded vote was: Mike Wiley — yes; Paul Tradewell — yes; Angie Bray Johnson — yes; Mayor Weston — yes; John West — yes; result 5 yes, 0 no. The resolution authorizes the city to proceed with the settlement framework but makes execution contingent on DNR sign‑offs and completion of the auxiliary agreements described by staff.
The council did not specify a final execution date; staff said the city would wait for DNR sign‑offs and the other agreements before signing the settlement. The meeting adjourned with the council scheduling its next meeting for Monday, Sept. 29, at 6 p.m.
