Planning commission postpones development hearings, approves withdrawals and names member to floodplain appeals panel

The Lehi Fayette Urban County Government Planning Commission on Sept. 11 voted to postpone two development items until Oct. 9, approved withdrawals of two applications and one waiver, and appointed Commissioner Molly Davis to serve on the Floodplain Appeals Committee.

The actions moved routine administrative items forward and changed the scheduling for several applicants. The postponements and withdrawals were handled largely by unanimous votes or with minimal discussion, and staff reminded the commission of an upcoming work session on affordable housing scheduled for Sept. 18.

The commission first approved the minutes of its Aug. 14 meeting. Commissioner Molly Davis moved to approve the minutes and Commissioner Jonathan Davis seconded; the motion carried unanimously, according to the record.

The commission then approved performance bonds and letters of credit as listed in the packet memorandum from Mr. Fairchild dated Sept. 11. Chair Davis moved the action and Mr. Forrester seconded; the motion carried unanimously.

Several applicants asked to postpone or withdraw applications. At the request of an applicant representative, Mr. Murphy, the commission granted a one-month postponement for PLN MJDP 25-42 (4075 Old Richmond Road) to the Oct. 9 meeting. "We are requesting a 1 month postponement," Murphy said. Mr. Forrester moved the postponement and Commissioner Wirth seconded; the motion carried unanimously.

Vision Engineering’s representative, Mark Bakktosch, asked that Development Plan 02/1952 for the Gainsway Mall Shopping Center at 1160 (Three‑eleven 65 Center Parkway) be postponed to Oct. 9 to finalize a sidewalk connection. Bakktosch said the project already has sidewalk on three sides of the proposed building and staff and the applicant need to "work a little bit more with the bicycle and ped planner, Scott Thompson, on sidewalk" to determine the best connection into the building. Commissioner Wirth moved the postponement; Mr. Wilson seconded and the motion carried unanimously.

Two items were withdrawn from the agenda. Vince Thompson, of Gibson Taylor Thompson Architects, asked to withdraw PLN MAR 2500012 ND1 (amendment); the commission approved a motion to withdraw a related application recorded in the minutes as PLN MAR 20512 for 1234 Scoville Road. Commissioner Molly Davis moved the withdrawal and Commissioner Jonathan Davis seconded; the motion carried with one abstention. The transcript contains inconsistent numbering for the withdrawn MAR application (the applicant referenced PLN MAR 2500012 ND1; the motion and minutes record PLN MAR 20512). The commission record does not specify which staff file number will be retained for recordkeeping; staff indicated the withdrawal will be reflected in the file and the matter will be returned to technical review where applicable.

The commission also voted to approve the withdrawal of a waiver request associated with the final record plat for Boonesborough Manor (PLN-FRP-25-00014), for property at 5354 Athens Boonesborough Road. Staff advised the commission that, while the bylaws specifically require a commission action to withdraw a zone change, they are silent on withdrawals for waivers; because a notice letter had been mailed, staff preferred the commission take formal action. Commissioner Molly Davis moved to approve withdrawal of the remaining waiver; Commissioner Jonathan Davis seconded and the motion carried unanimously. Staff clarified that the vote applied to the waiver request only, not the underlying plan.

On a separate personnel item, the commission appointed Commissioner Molly Davis to serve on the Floodplain Appeals Committee. Commissioner Forrester made the motion and Commissioner Jonathan Davis seconded. Ms. Davis said she would be "coming into it with a lot of not a lot of knowledge," and emphasized that "floodplains are important" and the need to protect them. The motion carried.

Staff closed the meeting with reminders of calendar items: Mr. Duncan told commissioners there will be a planning commission work session on Thursday, Sept. 18, at 1:30 p.m. on the third floor of the Phoenix Building to participate in an affordable housing roundtable. Mr. Duncan stated members of the public may attend the roundtable but will not participate in the invited discussion between commission members and guests.
