Magistrate orders owner to demolish or repair 3817 (Frederickson/Risoto) within 30 days or face $1,000 fine

Bay County's special magistrate ordered the owner of the property referenced at 3817 (listed in records as Frederickson Street / referenced in hearing materials) to either demolish the unfit mobile home and accessory structures or submit complete building-permit applications and complete repairs within 30 days, or face a $1,000 fine that would become a lien on the property.

The order, accepted at the Sept. 11 hearing, stemmed from an investigation and multiple inspections showing an unfit and unsafe mobile home with two unfit accessory structures. Inspector Thorpe and Investigator Tony Brunen described rotted rafters, open soffits, broken windows, significant wall and roof damage on additions and accessory structures and evidence of transient activity and debris inside the structures.

Catherine Ashman and other staff presented aerial photos and said no permits had been applied for and there had been no communication from the record owner. Notice was posted on the property and certified notices returned unclaimed. Code enforcement recommended the magistrate set a reasonable time of 30 days for compliance, provide detailed action plans and structural reports, require Florida-licensed design professional drawings where applicable, require that all required permits pass plan review and that all inspections be completed and permits finalized.

The magistrate accepted those recommendations and ordered that if the owner fails to obtain required demolition or building permits and complete the work within 30 days, a $1,000 fine shall be imposed and become a lien on the respondent's property. The order also states that failure will be deemed to have occurred if a permit is obtained and later allowed to expire or be canceled.
