At the Sept. 11 hearing Tim Justice, the magistrate and investigator, presented photographs and evidence entered as Exhibit A showing derelict vehicles, a trailer full of junk, appliances and scattered debris. Justice said the magistrate had earlier directed staff to abate the nuisance and that abatement work and contractor charges amounted to $4,312.
Code enforcement reported that the property had been claimed by a county-contracted company, that the work was completed and the site was found in compliance on June 27, 2025. Notices of final hearing were posted on the property and at the Bay County Government Center. The certified mailings were returned unclaimed.
The magistrate accepted the recommended order: the respondent is ordered to pay $4,312 in abatement costs plus statutory interest, an initial $700 fine plus statutory interest, and that the costs and fines may be recorded as a lien against the real property in Bay County public records under Chapter 21 of the Bay County Code.
The magistrate's order also preserves the Board of County Commissioners' authority to assess abatement costs pursuant to the county code.
