Bay County's special magistrate found the property at 9313 Jody Lane in compliance with cited code violations and closed code-enforcement case 23-00167 at a Sept. 11 hearing.
Tim Justice, special magistrate and investigator for Bay County Code Enforcement, presented an investigative report with photographs showing derelict vehicles, an unpermitted shed and other on-site debris. Justice said that at a June 19 compliance hearing the magistrate had found the respondent failed to comply with an earlier order and ordered staff to abate the nuisance and assess incidental costs as a lien if necessary.
Investigator testimony and subsequent photographic evidence showed that by July 15 the shed had been removed, overgrowth cut, and remaining items reduced to a mower and a truck. David Toole, who gave his mailing address as 9313 Jody Lane, told the magistrate he had complied with requirements, obtained permitting for the pole barn, and removed the items the county had cited.
Catherine Ashman and other staff noted certified notices had been returned unclaimed but that a regular notice had been received and a copy of the final notice was posted on the property and at the Bay County Government Center. Code enforcement recommended the magistrate impose the initial $700 fine plus statutory interest and record any costs as a lien if assessed.
The magistrate accepted staff's reporting that the property was now in compliance and closed case 23-00167.
The order retains the county's option to assess abatement costs as a lien under Chapter 21 of the Bay County Code if costs are later incurred.
