A project engineer explained the change is intended to ensure subsequent lot owners receive notice of ongoing maintenance responsibilities for stormwater facilities. Staff said, without a recorded agreement, title searches do not reveal maintenance obligations and lots can be sold without the new owner being aware of responsibilities for stormwater facilities. The amendment would make explicit in the ordinance that approved maintenance agreements be filed with the Register of Deeds prior to permit issuance.
