Trustees approve affordable-housing deed restriction for Mountain Valley Mobile Home Park

The Carbondale Board of Trustees unanimously approved an affordable-housing declaration of restrictive covenant for the Mountain Valley Mobile Home Park on Tuesday, a condition of the town funding contribution toward the park acquisition.

Staff presented a final draft of the deed restriction; Jared, a town staff member handling the transaction, told trustees the document incorporated prior legal comments and that the residents of the park had voted to accept the financing and the covenant terms. “If it's acceptable to you, you guys can move to accept this,” Jared said, recommending a board motion subject to minor staff or legal edits.

Trustees discussed enforcement language and which entities could enforce the covenant if the regional housing coalition named in the document ceases to exist. Staff and the town attorney said the agreement is written so local governments and donors could enforce the covenant if necessary. The board also heard that the town made a payment to West Mountain Regional Housing Coalition in anticipation of the closing.

Motion and outcome: Trustee Colin moved to approve the affordable-housing declaration of restrictive covenant, with legal adjustments as needed; Trustee Christina seconded. The motion passed unanimously.

Board members raised the prospect of annexation of the park after closing as a separate future discussion. Several trustees said annexation could unlock additional funding opportunities but noted it would be handled after the acquisition and would require separate legal work and negotiation.

Staff said the covenant approval allows the financing steps to proceed; the town’s payment to the regional housing coalition was processed the same day as the meeting.
