Council rezones 302‑acre tract for housing after developer presentation; vote 6–1

The Midland City Council approved by a 6–1 vote a rezoning ordinance to rezone a 302.39‑acre tract at the northeast corner of North Fairgrounds Road and Fire Wheel Road from a PD plan development district for housing to an amended PD for a housing development.

Developer Brent Behringer of Beatenville Homes and manager Chris Berry presented images of completed park and trail work in a related development and described amenities and homeowner association maintenance commitments. Behringer said the PD has enabled more affordable product types and community amenities; Berry confirmed the HOA enforces parking and other restrictions and has been towing vehicles parked more than 48 hours in violation of the rules.

Council members asked about HOA enforcement, unit counts and wells on the property; Behringer said the current plan anticipates roughly 1,200 homes but that active oil wells and tank batteries in the north could limit some lots until the wells are plugged. The rezoning was recommended by Planning & Zoning and staff and the council approved the ordinance with the stated conditions; the motion carried 6–1.

The developer said the project includes common parks, a network of trails under the power-line easement and roundabout landscaping and that the HOA will maintain the open spaces and trails.
