The Boone County Council opened and closed a public hearing on the proposed solid-waste budget during a regular budget session. The clerk announced that any member of the public wishing to speak on the solid-waste budget would have two minutes; no speakers appeared and the public-hearing portion was closed.
A council member moved and a second was given to include the solid-waste budget in the county’s proposed budget. The motion carried on a voice vote with the presiding official saying, “Motion carries.”
Why it matters: Public hearings are required for advertised budget items; closing a hearing with no public comment leaves the council to act on the advertised figures as presented.
