Olathe planning commission approves easement vacations for Kwik Trip site; item heads to City Council

The Olathe Planning Commission approved a request to vacate multiple public easements to accommodate construction of a Kwik Trip at 14904 West 100 and Nineteenth Street and voted to forward the matter to City Council.
Andrew Morgan, Planner II, told the commission the application seeks to vacate five drainage easements and one utility easement to make room for the proposed Kwik Trip. Morgan said all public-notification requirements were met, staff received one inquiry and the applicant received two general inquiries; staff recommended approval with no stipulations and noted the item will proceed to the Oct. 7 City Council meeting.
Commissioner Chappell asked whether the public questions related to the matter before the commission. Morgan said one question came from a property owner to the north who wanted to confirm the vacation would not affect their property. No members of the public spoke during the hearing.
A motion to approve “VAC25-two” passed on a roll-call vote with affirmative responses from Commissioners Lynn, Creighton, Brown, Tirones, Chapman and Chair Janner. The commission’s vote clears the easement vacations to move forward to the City Council for final action on Oct. 7.
The application materials presented to the commission show the vacations are intended to accommodate the proposed convenience store and fueling facility; staff recorded two public inquiries to the applicant and one to staff and said their questions were answered. The applicant was present at the meeting but made no presentation and was available to answer questions.
