A Sun City resident raised concerns that facilities agreements and the associated capital preservation fee (PIF) and capital improvement fee are not always recorded at property closings, and that RCSC may be missing thousands of dollars as a result.
Cindy Brown, who said she has more than 40 years in land title and title insurance, told the board she found "at least 7 homes" near her neighborhood without recorded facilities agreements and estimated the uncollected fees at roughly $38,500 based on current fee levels. Brown described the facilities agreement language in the corporate bylaws and CC&Rs that, she said, requires new deeded owners to sign and pay annual and other fees, including a $1,500 capital improvement fee and a $4,000 PIF (preservation improvement fee).
RCSC Director of Finance Kevin McCurdy said staff are aware some sales do not go through traditional title channels and that management is "constantly researching and reviewing ownership transactions" to identify unreported transfers. "If we are made aware after the fact, we will go after the proper fees and the proper documentation of that home sale," McCurdy said.
McCurdy and the board urged members who suspect a missed filing to submit addresses or documentation so staff can investigate. "Let's see if we can clean that up if indeed that's the case," President Tom Foster said.
What was not resolved: The transcript records member claims of missed filings and finance staff assurances that the department will research and pursue unpaid fees, but no formal audit or timeline for recovery was announced at the meeting.
