ZBA grants special permit for 10-car used-car lot at 67 Main Street with septic upgrade deadline

The Lakeville Zoning Board of Appeals on Jan. 17 approved a special permit allowing used-car sales (up to 10 vehicles) at 67 Main Street, a property owned by David A. Rose.
David A. Rose told the board he bought the former John Ryder building and has opened a small used-car lot. He said the lot is commercially zoned and he previously received a dealer’s license from the Board of Selectmen, but needed the ZBA special permit to place 10 unregistered vehicles for sale along the Main Street frontage.
“I've opened a small used car lot there. I was granted a dealer's license from the Selectmen … even though it is commercially zoned … I would need to get a special permit for the 10 car dealer's license that we have for the property,” Rose said.
Rose told the board the business will be sales by appointment only; no repairs, no storage of hazardous materials, no scrap vehicles, and no boats, RVs or trailers. He said there will be customer parking behind the buildings and the 10 vehicles on the front lot will be the inventory for sale.
The Board of Health reviewed the property and reported that a Title 5 inspection was not conducted at transfer. The health board voted to allow the petitioner until May 3, 2020, to replace the existing cesspool and required the cesspool to be pumped every six months until the upgrade is completed. The Board of Health stated it will condemn the building if the septic upgrade is not completed by that date; no extensions or variances would be granted, the memo said. The petitioner told the ZBA he plans to tear down the existing building and replace it within two years.
The planning board reviewed the petition and offered no comment. Board members also asked about surfacing and whether the lot had been paved; Rose said the lot currently uses crushed gravel and dirt in the back but that the front area would be used for the 10 vehicles. Several members praised Rose’s track record of improving properties he has taken over.
A motion to accept the petition as presented was made and seconded; the board voted in favor and the permit was issued for 10 unregistered cars for sale. The board clarified the permit covers cars and small pickup trucks only.
