The Shawnee County Board of Zoning Appeals voted to approve an exception to the county’s accessory-building size limit for a property at 2245 SE Tucumsee Road, allowing an 1,848-square-foot lean-to to be attached to an existing accessory building.
The exception was approved after staff presented the application and recommended approval with one condition: that no commercial business, profession, trade or residential living be conducted within the structure in accordance with a Shawnee County resolution.
Staff told the board the proposed lean-to would attach to an existing 39-by-84-foot accessory building, measure 22 by 84 feet with one open wall, and would exceed the county’s maximum allowable accessory-building area by 1,118 square feet. Staff said owners had the option to modify plans but chose to apply for an exception, which by county rules is handled by the Board of Zoning Appeals.
No members of the public spoke for or against the request during the hearing. After a motion and second, the board took a roll call vote and the measure was approved; staff noted in the record that the application had been approved and that the usual referral to another body did not apply in this case.
The board’s approval is limited by the staff condition barring commercial or residential use inside the structure; staff said the condition is tied to the county’s zoning rules and a Shawnee County resolution cited in the staff report.
The board closed the BZA hearing and reconvened as the Planning Commission.
