Carroll County staff seeks authorization to join recent opioid settlement participation agreements

Kurt, a county staff member, asked the Carroll County Board of Supervisors to authorize the county to sign participation agreements for several recent national opioid settlements and to place a prepared resolution on a future board agenda for formal approval.
Kurt told the board he had read settlement documents and identified three settlement streams: a distributor settlement involving Sandoz (which he described as roughly $99.5 million), a large settlement with Purdue Pharma and the Sackler family (which he described as $7.4 billion), and a preliminary participation agreement covering eight manufacturers. He said the state of Iowa will receive a portion of each settlement under an allocation memorandum of understanding and that counties will receive funds distributed under that agreement.
Kurt said the Sandoz allocation process would follow the county's prior participation and that, from his reading of the Sandoz agreement, Carroll County's share would be about 0.603 percent. He said the Purdue Pharma settlement is subject to bankruptcy-court approval and that payments under that agreement are expected to be spread over about 15 years. He asked the board for authorization to sign the participation documents and presented a draft resolution to formalize participation.
Board members and staff discussed timing and administrative details. Kurt said the participation documents require a signature by Sept. 30 and asked that the board authorize placement of the resolution on the Sept. 15 agenda (the board later agreed to assign a resolution number and put the item on either the Sept. 15 or Sept. 22 agenda). Kurt apologized for not distributing the resolution earlier and offered to provide a Word copy for review.
No final vote on participation was taken at the meeting. The board agreed to assign a resolution number and schedule the resolution for a future meeting so the board can consider formal approval after review. Kurt and board members noted that attorneys' fees will be paid from the settlements and that distribution to counties will follow Iowa's existing allocation memorandum of understanding.
The matter will return to a future meeting for formal action once the resolution is placed on the agenda and the board has had time to review the documents.
