The Metro Nashville Board of Zoning Appeals voted Sept. 4, 2025, to grant a variance from the side‑street setback requirement to permit an existing restroom and storage container at 2300 Clarksville Pike, allowing continued use of a food‑truck court on the site.
Board staff presented case 2025‑86 and explained the CS (commercial) district requires a 15‑foot street setback in commercial zones; the applicant requested relief for a portion of a building that sits roughly 3 feet inside that setback. Allison Patton, listed as the appellant, told the board the containers and restroom have been in place while the food‑truck park operated for about five years. She said the park served the North Nashville community during the COVID period and that pedestrian access makes the use valuable for people without transportation.
When members discussed the request, several cited the lot’s unconventional parallelogram shape and said strict enforcement of the setback would push improvements into awkward positions. One member said the restroom is not directly adjacent to the roadway and noted the lack of a sidewalk there. A motion to approve the variance was made and seconded; the chair called for a vote and announced the motion passed. The record shows the vote was unanimous among participating members; the chair noted Mr. Ransom did not participate in that case.
Staff told the applicant to follow up with the codes department beginning Monday for permit processing.
