The Marathon County Infrastructure Committee unanimously voted Sept. 4 to recommend that the county board approve a quitclaim deed transferring a small, erroneously retained strip of county land along County Truck Highway P in the Town of Old Plain to the adjacent church landowner.
County highway staff explained the county’s records show a description error dating to 1987: an exhibit shows a narrow rectangle within the church parcel that appears to have been unintentionally retained by the county because the legal description was written 33 feet short. Staff said the original intention at the time of sale appeared to have been to convey the full area to the church owner.
Highway staff recommended three options: retain the strip, sell it at fair market value, or convey it by quitclaim deed and require the church to pay for any title work. Staff recommended the quitclaim deed with the church bearing the title expenses. Committee members said that aligned with past practices and moved to recommend the transfer. The motion, made by Supervisor Jensen and seconded by Supervisor Dickinson, passed unanimously and will go to the full county board for final action.
The committee recorded no objections and no additional conditions beyond the recommendation that the landowner handle title work at their expense.
