Town delays temporary certificate of occupancy for 329 Burnway until landscaping, patch repairs meet planning commission standards

Interlaken planning and building staff told the council they will not grant a temporary certificate of occupancy (TCO) for the 329 Burnway project until the developer submits a landscaping plan acceptable to the planning commission and completes a required asphalt patch repair.
Diana, a planning official, said the project has been contentious and that the planning commission's conditions include repairing an asphalt patch used for electrical access and addressing an erosion-prone gravel landscape that has deposited debris on a neighbor's lot. She said the applicant's initial landscaping response appeared to rely on hydroseeding over gravel, which the commission found inadequate.
"They got the patch done great, but they're not gonna get a temporary CO until we see a detailed landscaping plan that satisfies the planning commission's concerns," Diana said. She said the town will set a deadline for completion and that failure to meet that deadline could result in revocation of the TCO and discontinuation of water service.
Staff characterized enforcement options as limited to financial penalties and water-service controls; they said those are the town's principal remedies when other enforcement tools are ineffective. No TCOs were issued at the meeting and the council did not take further action beyond supporting staff's approach.
