Board approves series of non-enforcement variances; clarifies Cool Creek and fence encroachment changes

The Hamilton County Drainage Board voted Sept. 8 to approve a batch of variances and non-enforcement items and recorded clarifications on several items, including Cool Creek and a fence encroachment.
A board member moved to approve items 1 through 7 on the non-enforcement list; the motion passed by voice vote. For item 8, staff clarified the correct creek name and that the approval should be listed under Cool Creek rather than Williams Creek. The board recorded that change and approved the Cool Creek non-enforcement.
On a separate inflow, staff explained an amendment to a previously approved fence encroachment: field location of the drain showed the drain closer to the property line, so the fence will be west of the drain and “there's no need for gates,” removing the requirement that had been included in the earlier approval. The board approved that amendment.
The board also approved additional variances for Williams Creek Drain (JR Columns arm) and Crossfields arm on the record; motions passed by unanimous voice vote. Board members asked for fuller documentation of items 10 and 11, which some members had not received in the packet.
The board recorded two surety releases — Carter Lumber Willowview Road Drain Improvements and erosion control on the Frank Kaiser Drain at 16337 Atlantic Road — and noted construction updates elsewhere on the agenda.
