Planning commission recommends preliminary approval for 22‑lot Barker's Haven subdivision with conditions

The North Ogden City Planning Commission on Oct. 25 recommended preliminary plat approval for Barker's Haven Subdivision Phase 1, a 22‑lot subdivision proposed at approximately 1050 East and 2400 North, after staff outlined several conditions to be satisfied at final plat.
Ryan Nunn, city planner, told the commission the property was annexed into the city earlier this year and was assigned the R1‑10 zone, which requires 10,000‑square‑foot interior lots, 11,000‑square‑foot corner lots and 90‑foot frontages. Nunn said staff reviewed the phase 1 plat and recommended approval so long as conditions are met at final plat, including verification of lot frontages, showing a turnaround at the north dead end, and securing assurances for a future roadway connection where the developer asked not to dedicate full right of way now.
Nunn said, “With this phase 1, it's the 22 lots. ... With that annexation, there were some, a development agreement where as as well.” He described unresolved items to be finalized at the final‑plat stage: confirming corner‑lot frontage measurements, showing the required dead‑end turnaround and documenting an assurance (deed, easement or other legal instrument) that the remaining roadway will be completed when phase 2 proceeds.
Commissioners asked about a proposed private road on the south side of the subdivision and whether off‑site users — including property owners near the fish farm area and access from Fruitland — would have rights to cross it. Nunn said the city engineer has indicated the city can accept a private road under the land‑use code and that utility responsibilities and limits of city maintenance would be defined in design and legal documents. He cautioned that final plat language might need to clarify who has rights to cross the private road.
Mark Hansen, representing John Hansen Real Estate and the Barker family, said the developer planned to use a partial dedication or deed that would leave a gap now but include a legal requirement that the access to Oak Lawn Park be completed when phase 2 is developed. “It would leave a gap, but that the deed would kind of create a ... when phase 2 comes in, you have to utilize that as the access to Oak Lawn Park and build out the road,” Hansen said.
Nunn also noted a proposed 30‑foot private right of way on the south side and that the city engineer requested a 23.50 (as shown in the engineering comments) dimension related to roadway/trail connection adjacent to Oak Lawn Park; staff said they would work with the developer to document the city’s interests in a letter or deed if full dedication was deferred. He also said the plat should show an outlet easement for a stormwater pond and that easements across private parcels must be in place before final plat acceptance.
Commissioner Warren Green moved to recommend preliminary plat approval of Barker's Haven Phase 1, adding a condition that the private road access be defined on the final plat and subject to the other staff conditions; Commissioner Watson seconded. The commission voted unanimously to recommend approval.
The recommendation will move to the administrative final‑plat process and must demonstrate compliance with the engineering comments, staff conditions and any required legal assurances before a final plat is signed.
