Council upholds planning commission on Dutch Bros conditional-use permit after denying continuance request

The Moreno Valley City Council on Sept. 2 denied a request to continue an appeal hearing and unanimously upheld the Planning Commission's conditional-use permit approval for a proposed Dutch Bros coffee drive-through (PEN24-0013).
Deputy City Attorney Colin Kirkpatrick presented the staff report and recommended opening the continued public hearing and taking testimony. Appellant counsel Michael Ellaez asked the council for additional time, saying his client had not received timely notice and had only recently received key documents, including a traffic study. Ellaez said the appellant would likely have withdrawn the appeal had the notice and documents been provided earlier.
Several members of the public spoke in favor of the project. Russell Schafer told the council Dutch Bros would be a good fit on Alessandro Boulevard and would reduce pressure at an existing Dutch Bros location on Hemlock. Luis Palomares and others supported the project as well.
Council Member Delgado moved to deny any further continuation and to adopt Resolution No. 25-2025x denying the appeal (PAA25-00002) and upholding the Planning Commission's approval of Conditional Use Permit PEN24-0013 without modification; the motion was seconded and carried by voice vote 4-0.
The council's action keeps in place the conditions approved by the Planning Commission and allows the project to proceed under those requirements, as summarized in the staff report and the Planning Commission record.
