Valley County tables Abstein Bridal bids after conflict of interest, seeks legal review

The Valley County Board of Commissioners on Wednesday agreed to table a decision on the Abstein Bridal bids and set a special meeting for Sept. 11 after one commissioner recused herself and staff flagged legal questions about a bidder's failure to acknowledge a bid addendum.

A commissioner identified herself as needing to recuse because of a conflict of interest and logged off the meeting. County staff said they had not obtained a definitive written legal opinion because of short notice and office closures; staff said the county prosecutor's office has an email from the bidder acknowledging addendum 2 but not a formal letter on company letterhead.

Commissioners discussed whether the bidder's failure to include a written acknowledgment of addendum 2 in the bid packet could expose the county to a challenge from other bidders. Staff and commissioners said the issue "could go either way" legally and that they would not proceed without input from the county prosecutor's office. The board directed staff to schedule a special ("specialty") meeting for the morning of Sept. 11 to take up the bids when legal counsel can attend.

Commissioners also scheduled a separate workshop on Sept. 9 to discuss the McCall impact area; the bids item was proposed for the Sept. 11 meeting to ensure recused commissioners or legal counsel could attend. Commissioners noted that one bidder wrote an email acknowledging addendum 2, which staff forwarded to the prosecutor's office, but staff said the county had not received a formal letter on company letterhead.

Action and next steps: the commissioners tabled the Abstein Bridal bid decision pending legal counsel input and reconvened consideration at a special meeting on Sept. 11. Staff was asked to ensure the prosecutor's office is present and to obtain written documentation from bidders about addendum acknowledgment.
