Planning commission recommends minor zoning ordinance amendments to clarify uses, fees and animal rules

The Eaton County Planning Commission on Sept. 2 recommended a set of minor text amendments to the county zoning ordinance to update enforcement fees, clarify allowed dwelling types and animal language, and adjust application escrow and fee language for communications towers.
At its Sept. 2 meeting, the Eaton County Planning Commission voted to recommend that the Board of Commissioners adopt several text amendments to the Eaton County Land Development Code intended to clarify language on fees, dwelling types, animals and tower-application escrow.
Staff said the proposed changes include: matching civil infraction fines and enforcement penalties in Article 3.8 to the county’s approved fee schedule; removing the word “single-family” from the Limited Agricultural intent statement and explicitly allowing duplex dwellings in the Limited Agricultural district; revising low-density residential language to remove the word “livestock” so owners can keep chickens and other small livestock consistent with recent legislation and the Right to Farm Act; and changing section 14.274 to remove application-fee language for communication towers and to increase the escrow for expert review to $1,000 while leaving the application fee set by the county fee schedule.
Staff reported the Eaton Conservation District had no concerns and that Eaton Rapids Township’s position was mistakenly listed as denied in the draft staff report; staff corrected that Eaton Rapids Township approved the amendments. Commissioners described the edits as refinements and minor clarifications to align the zoning ordinance with current practice and state law.
The motion recommending DCA-9-25-3 to the Board of Commissioners passed by roll call with all commissioners present voting yes. The recommendation will be forwarded to the Board of Commissioners for final action.
