The Southlake City Council approved multiple planning and zoning items on Tuesday night, including site plans, an encroachment agreement, specific-use permits and sign variances. Council handled the items largely as a group and recorded votes or tablings on several separate motions.
Key approvals and outcomes (Votes at a glance): - Colby Building site plan and encroachment agreement (1480 W. Kirkwood Blvd.): approved 7-0. The council approved the site plan (item 6A) and an encroachment and joint-use agreement to allow a raised curb and concrete driveway to occupy a portion of a 15-foot drainage easement (item 6B). Director Dennis Kilo presented the plans and the applicant (Skip Blake) told council the design had been modified with staff to reduce impacts.
- Specific-use permit for an accessory building at 1947 E. Continental Blvd. (Case EA25-0038, item 6C): approved 7-0 subject to the applicant moving the building to a minimum 10-foot south setback and installing evergreen screening (council-approved Option A). Applicant George Johnson said the structure is used for storage and the council noted the owner's representation that it is temporary.
- Clarendon School zoning and site plan for a proposed unlit sport court at 100 Clarendon Ranch Road (item 6D): approved 7-0 on second reading. Applicants said the court will be used by students during daytime hours only; council added an explicit note in the motion that the approval does not authorize lighting.
- Pecan Creek Professional Center (731 Zena Rucker Road; item 6E): second-reading zoning and site-plan approval 7-0 to add a nonmedical spa-type use to the permitted uses under the SP2 zoning district.
- Southlake Classic Pet Retreat (1211 & 1213 Brumlow Ave.; item 6F): second-reading approval 7-0 to change zoning to SP1 detailed site plan district and make a long-running kennel a conforming use; applicant said the change is primarily to clean up legal nonconforming status.
- Scooter Superstore (2120 & 2150 E. State Highway 114; item 6G): second-reading approval 7-0 with the applicant agreeing to grow hedges taller to screen vacuum stations and to consider beautification of the southeast corner at Kimball and SH-114.
- Zoning ordinance amendments to conform to recent state law changes (item 6H): second-reading approval 7-0. The ordinance updates the city's ordinance to adopt statutory language about notice for changes that would render uses nonconforming, requires specific website and newspaper posting and sets a 24" x 48" public-hearing sign requirement; staff noted the legislative text is prescriptive and must be used verbatim for some elements.
- CEMA (SEMA) headquarters site plan and specific-use permit for an accessory structure at 380 S. Nolan Drive (items 6I and 6J): both approved 7-0. The project includes phased landscape and paving enhancements and a detached covered pavilion for employee activities.
- Sign variance for Smart Quest (280 Commerce St., Suite 105; item 9A): approved 7-0 with conditions. Council approved a larger sign area and a 31-inch logo height but limited colored lettering in the "steam" graphic; the council motion allowed the owl logo as pictured and required no colors in the steam/lettering (applicant representatives requested the color scheme but agreed to the council's conditions).
- Burger King drive-through signs (125 N. Kimball Ave.; item 9B): tabled at the applicant's request to Oct. 7. City staff and council asked the applicant to return with a consolidated, masonry-framed proposal that integrates the newly installed digital canopy/menu screen and the existing menu board; staff and council flagged structural and permit issues and asked the applicant to bring a full, compliant design.
- Plat showing for Lots 19 and 20, Woodsy Court (1207 & 1209 Woodsy Ct.; item 9D): approved 7-0 with a variance to the subdivision sidewalk requirement; council waived escrow for a future sidewalk consistent with prior variances on the street.
- 1965 & 1975 N. Whitechapel Blvd. rezoning and development plan (item 7B): the council tabled the first-reading rezoning and development plan to the Oct. 7 meeting at the applicant's request to allow further design options. Staff and council discussed street geometry and fire-department turnaround requirements and asked the applicant to explore a 3-lot scenario or alternate turnaround designs.
What council said: Director Dennis Kilo presented most planning items and outlined staff findings and public-notification results; in many cases staff noted there were no responses from the public notification area. Council members generally approved items subject to staff-recommended conditions. For the Burger King menu/canopy installation, councilmembers advised the owner to produce a consolidated masonry-framed solution that would meet the sign ordinance rather than retrofit small pieces.
Context and process: Many of the zoning items were second readings of previously introduced matters; several minor site plans and sign variances were handled with relatively little discussion. For larger or more complex projects (the Whitechapel subdivision and the Burger King signage/drive-through), council referred applicants back for more design work.
Ending: A number of items will return to council on Oct. 7 after applicant revisions (notably the Whitechapel subdivision and Burger King sign package). The rest of the approved items will proceed with conditions set by council and staff.
