Rental Housing Committee adopts amendments to Community Stabilization and Fair Rent Act regulations

The Rental Housing Committee on Aug. 28 voted to adopt amendments to the Community Stabilization and Fair Rent Act regulations, approving changes to chapter 1 (purpose), chapter 2 (definitions) and chapter 3 (code of conduct).
Staff said the amendments are intended to "clean up, clarify, and update the regulations and improve the CSFRA regulations as a tool for implementation, administration, and enforcement of the CSFRA." The package includes a new section giving staff limited authority to make minor, nonsubstantive regulatory amendments to improve clarity and streamline administration.
Why it matters: the changes add precise definitions for covered rental units (including treatment of units receiving housing-assistance payments), add defined petition types (rent increase/decrease, specified capital-improvement, joint petitions and one-time utility adjustment petitions), and revise meeting-adjournment and conduct language in chapter 3 to better reflect Brown Act requirements.
During deliberations Vice Chair Cox read a staff Q&A into the record about recourse if a committee member disagrees with a staff-made minor amendment; staff clarified minor amendments will be placed on the consent calendar and any member may pull the item for discussion. "If a member of the RHC disagrees with a minor amendment by staff, they would be able to pull the item from the consent calendar per the usual process and open a discussion," the staff response said, as read by Vice Chair Cox.
A motion to adopt the amendments was made by Member Hislop and seconded by Member Brown; the motion passed unanimously.
Ending: staff said the recommended administrative review will continue in coming months, with additional chapter amendments to be brought forward for committee review.
