Consultant Cody (Parametrix) reported that the second bid addendum associated with the project was not signed or dated by the apparent low bidder in the materials Parametrix reviewed. Parametrix’s initial assessment concluded that, if the addendum were material, the county could face a legal challenge if it awarded the contract without resolving the irregularity.
The apparent low bidder emailed county staff to say their team had seen the addendum and considered its content to be clarification — effectively a question‑and‑answer item — and that the addendum would not have altered their price. The bidder also noted that Idaho public‑bidding rules and the county’s documents permit the county to waive non‑material irregularities in bids where appropriate.
County economic‑development staff told commissioners there is no additional program funding currently available to wait through a prolonged rebid process. Consultant and staff assessments indicated rebidding the project could delay delivery of a prefabricated bridge and jeopardize the timetable required by the grant or project schedule. Project timelines from the bridge fabricator suggested a multi‑month lead time required for engineering, fabrication and delivery.
Commissioners directed staff to obtain a formal legal opinion from the county prosecutor and asked the apparent low bidder to provide written confirmation that the addendum was a clarification and would not have affected the bid. The board deferred a final award decision until next week to allow the prosecutor to review the materials.
