Commission issues negative determination for porch at 19 Pine Bluff with condition to notify agent if soil disturbance occurs

The Lakeville Conservation Commission on Aug. 26 opened and closed a public hearing on a request for a determination of applicability for 19 Pine Bluff and issued a negative determination with one condition: if any soil disturbance occurs, the conservation agent must be notified and sedimentation controls may be required.
Mark Minton, the town conservation agent, and commission members inspected the site and reported that the proposed porch will tie into the existing foundation and sit on an existing retaining wall. Applicant Nina Salomon told the commission the porch “will hook into the foundation where the existing house shuts out...it’ll go right across with a beam to the retaining wall that’s there.” The agent recommended a negative determination because the work, as presented, is largely outside the 100-foot buffer and is not expected to cause soil disturbance.
The commission’s decision includes a condition that any stockpiling of material or unanticipated soil disturbance in the buffer zone must be avoided; if stockpiling or excavation is necessary, sedimentation controls must be installed and the agent notified.
The motion to close the hearing and issue a Negative Determination (No. 3) passed by voice vote; commissioners present answered “Aye.”
