The Far West Planning Commission voted unanimously to recommend that the City Council approve a development agreement and a modified site plan for Peterson Inc./Peterson Properties, the commission agreed during a public hearing and motions on the items.
The development agreement covers a portion of the larger property and formalizes steps to bring older buildings and utilities on the approximately 28-acre site into compliance as new construction proceeds. Commissioners said the agreement ties obligations to the site, requires removal of the roller coaster building as a condition of Peterson Inc. being released from certain obligations, and records commitments that will remain with future owners.
Commissioners heard that the applicant provided a site-wide plan and submitted stormwater calculations and drainage information to city staff. City staff and the city engineer reviewed the materials; in the planning packet the city engineer noted that the applicant provided a stormwater report, storm drain pipe and detention calculations and supporting material. Public works staff and the commissioner discussion indicated the detention basin and drainage system on the north side are sized to convey recent runoff and that flows from the site discharge into the city's ditch system rather than the western irrigation features.
Commissioners said the development agreement and the modified site plan create a starting point for the larger property: the agreement requires that future phases or additional development must submit site plans and meet city standards as those projects move forward. The commission's motion language underscores that the agreement "runs with the land" and binds successors, a point commissioners said reduces the risk if ownership changes.
Motions and next steps: the commission recommended approval of the Peterson Inc. development agreement (motion by Lyle; second by Jason) and separately recommended approval of the modified site plan (motion by Darren; second by Connor). Both recommendations were passed by voice vote and will be presented to the City Council at the next council meeting for final action.
Commissioners noted that some clarifying items—recording language, confirmation that stormwater calculations were transmitted to staff, and the timetable for removing the roller coaster building—are included in the development documents and memos from city staff. Planning staff said they will send an explanatory email to City Council ahead of the council hearing to provide background on how the commission reached its recommendations.
The commission closed the public hearing with no members of the public offering opposition at the meeting. The commission’s record will go forward with the staff memos and the stormwater report attached to the council packet.
