Take Line Appeals Panel elects Bart Davenport chair, Josh Small vice chair; reviews duties for Heath lakeside permits

The Take Line Appeals Panel elected Bart Davenport chair and Joshua (Josh) Small vice chair and reviewed its responsibilities for hearing permit appeals involving docks, walkways, retaining walls and tree clearing on city-leased property along Heath.

The panel convened at 5:28 p.m. and voted 4–0 to approve Davenport’s nomination as chair and then unanimously approved Small as vice chair for a one-year term. During the meeting staff described the panel’s role in reviewing appeals when an applicant seeks an exception or variance from city code for work on property the city leases from the City of Dallas along the west boundary of Heath.

Joan Marshall, chair of the Take Line Appeals Panel, opened the meeting and led an orientation explaining that staff first review permit applications for docks, walkways, retaining walls and tree clearing. Marshall said appeals arrive to the panel when staff (identified in the meeting as “Lisa”) denies a permit or requests a variance. The panel’s duties, she said, are to listen to facts and evidence, ask questions, deliberate, and vote on whether to grant exceptions consistent with city code and any requirements set by the City of Dallas, which owns the underlying property.

Marshall explained the process the panel will follow in hearings: staff presents the permit file, interested neighbors or applicants speak, panel members ask questions, deliberation occurs, a member makes a motion, another member seconds it, and the chair calls the vote. Marshall also said Robert’s Rules of Order would govern conduct of meetings and votes.

Bart Davenport introduced himself during the nominations. “This is Bart Davenport. I’m happy to serve as chair,” he said. Joshua (Josh) Small identified himself when seconding the chair nomination: “This is Josh Small. I second that.” The panel then held a voice vote that Marshall characterized as approved 4–0.

Members were told appeals are infrequent; staff said they typically see one or two appeals per year. Marshall emphasized that each appeal is evaluated on its own facts and on how proposed work would affect adjacent property owners, noting that take-line boundaries differ by parcel. She also noted that the city’s codes must also conform to any controls required by the City of Dallas because the city leases that land.

The panel also addressed a scheduling issue: the meeting was supposed to start at 5:00 p.m. but began at 5:28 p.m.; staff apologized for the timing discrepancy and said they would try to prevent recurrence. The meeting adjourned at 5:44 p.m.

Members present and participating in the meeting were Joan Marshall, Lynn Tran, Joshua Small and Bart Davenport; one member, Karen Koepke, was absent. Staff referenced a planner named Lisa as the reviewer of take-line permit applications.
