Agenda language identified the item as two Level 3 independent grievances of Valentin Ruiz to be heard consecutively and noted a possible closed session under the Texas Government Code §§ 551.071, 551.074 and 551.082(a)(2). Trustee Alfredo Gustavo Perez advised the board the grievance should be handled in closed session, saying, "In closed session." The board voted to move into executive session; the presiding officer recorded the time in the public minutes as 5:32 p.m.
The board returned from executive session at 7:51 p.m. The presiding officer stated on the record that no action was taken during executive session. The board then solicited motions on each grievance; hearing no motion on the first grievance, the board took no formal action on it. Hearing no motion on the second grievance, the board similarly took no formal action on that matter.
Because the determinations were handled in closed session and the board reported no public action, there is no public disposition or vote on the grievances recorded in the meeting minutes. The agenda cited Texas Government Code sections governing attorney consultation, personnel matters and student records/confidentiality as grounds for the closed meeting.
