A resident, Christie Bittner, presented a lengthy set of questions to the Pittsburg City Commission about the status of the Silverback Landing development, whether PNL Development met conditions of a 2018 agreement, and whether a newly referenced Silverback Landing LLC and its board members present conflicts of interest.
Bittner cited specific provisions of a development agreement and asked whether completion documents, turnovers of infrastructure, title transfers and written city objections had been filed as required. She also asked whether the Silverback Landing LLC had assumed assets and liabilities from PNL Development and whether the city had received written conflict-of-interest disclosures from board members.
City staff acknowledged the project’s shortcomings and told commissioners the city has withheld tax dollars in the past when contractual performance did not meet expectations. The city said many streets and certain infrastructure have become city streets through acceptance processes, and staff emphasized the need to identify a local entity that can be held accountable for completing outstanding obligations. City staff asked Bittner to meet with staff to walk through her questions in detail and said they will seek written answers from attorneys and developers when available.
Commissioners and staff said they want a local entity (a community development corporation/CDC) that can be held responsible to finish the remaining work and manage assets and liabilities. Staff said they would provide responsive materials and would work with Bittner and the developer’s attorneys to answer outstanding questions. No formal enforcement action or vote was taken during the meeting.
Bittner’s statement referenced named individuals she said were on a board; staff clarified the Silverback Landing community development corporation is a separate entity and that listed members were included because of the positions they hold in the community. Staff said they are continuing efforts to transfer authority to a responsible local group and invited Bittner to set an appointment with staff for detailed follow-up.
