Votes at a glance: Council approves AutoZone conditional use, pension lump-sum and telecom right-of-way updates; postpones related downtown items

The Boca Raton City Council on Sept. 22 approved four formal actions by unanimous votes, including a conditional use to allow a retail tenant in an existing industrial district building, a one-time lump-sum pension payment for eligible retirees, and an updated telecommunications right-of-way agreement. The council also amended its agenda to postpone certain downtown items to Nov. 18, 2025.

Resolution 1412025 — Conditional use approval (AutoZone site): The council adopted Resolution 1412025, granting a conditional use approval for approximately 0.51 acres at 104 Northwest 20th Street to authorize up to about 10,560 square feet of retail use in an existing building in the M-2 General Industrial Zoning District. Heather Hanson, senior planner in Development Services, presented site history and proposed landscaping and parking improvements. The applicant’s design representative, Mario Amador, said he had no additional presentation. Council member Wigter moved to adopt the resolution; Council member Thompson seconded. Vote: 5-0 (Wigter, Thompson, Singer, Drucker, Nacklis).

Ordinance 57-50 — General employees’ pension lump-sum payment: The council adopted Ordinance 57-50, which authorizes a one-time lump-sum payment to certain retired or disabled general employees to offset erosion from cost-of-living changes. As presented by the city’s finance staff, the proposal calls for a 5% lump-sum payment for retirees before Oct. 1, 2015, and a 3% payment for retirees between Oct. 1, 2015 and Oct. 1, 2020. The total cost is $490,465; the plan will make the payments and the city will reimburse the plan the same amount so as to have no net impact on the plan’s unfunded liability, per staff. Vote: 5-0.

Resolution 1472025 — Telecommunications right-of-way use agreement: The council authorized the city manager to execute a rights-of-way use agreement with Telesis Cable USA Inc. (also referred to in staff remarks) to update existing agreements governing telecom conduits and adjust the cost-per-linear-foot payments for conduits in city right of way. Public commentators raised questions about environmental impacts and whether the cables principally serve offshore destinations; Public Works director Zach Bier and other staff described an existing history of transoceanic cable landings at Boca Raton and said the agreement updates the city’s existing right-of-way terms. Vote: 5-0.

Agenda amendment — Postponement of items to Nov. 18: Early in the meeting the council approved an amendment to postpone items identified as 11 b 1 and 11 b 2 (related to the downtown project) to the second November meeting (Nov. 18, 2025). The motion to amend the agenda passed 5-0.

Votes: All four formal actions were approved unanimously by the five-member council present. The clerk recorded the roll call after motions where required.

These votes finalize the conditional-use approval and two administrative updates; the downtown P3-related items were postponed for later consideration and additional public engagement.
