Depew ZBA grants variance for porch/deck at 33 Mona Court on papers

At its Sept. 11, 2025 meeting the Zoning Board of Appeals of the Village of Depew voted 5–0 to grant an area variance allowing a porch/deck to be attached on the north side of 33 Mona Court within the minimum front-yard setback.
The application notice listed Frank Barone as the applicant for 33 Mona Court. No one appeared at the hearing to speak on that application; the board proceeded on the written record after staff and legal counsel outlined options for the board to either act on the papers, adjourn the hearing or deny the application.
Before voting the board read the applicant’s written answers to New York’s area-variance criteria into the record. The application stated the proposed addition would not change the character of the neighborhood or create detriment to nearby properties; the applicant indicated the benefit sought could not be achieved without major expense such as adding a basement or garage. The application identified the minimum variance necessary as 4 feet.
Member Yarborough moved to grant the variance; Member Galvin seconded. Roll call votes recorded Overholt — yes; Galvin — yes; Menard — yes; Yarborough — yes; Chairman Delaney — yes. The motion carried, 5–0. The board closed the hearing and recorded no conditions attached to the approval.
Legal staff advised the board it could adjourn if members had unresolved questions about the application; members said they had no further questions and chose to decide on the papers. The board did not record additional findings beyond what the applicant supplied in writing.
