Boone County RDC signs letters to Whitestown over unpaid TIF-related invoices, approves invoices for counsel

Commissioners at the Boone County Redevelopment Commission meeting discussed unpaid payments from Whitestown under a prior-rate memorandum of understanding (MOU) related to a fire-rate TIF and directed staff to sign two letters providing specific direction to Whitestown.

Presenters told the commission that Whitestown has not paid amounts under a prior-rate MOU and that staff will sign two letters drafted by Brian Colton that need signatures from the commission chair and others. The meeting record shows staff said one invoice from Ice Miller reflects a zero balance but had been re-submitted multiple times by staff for payment. Commissioners discussed whether to change trustees for certain accounts; one presenter noted a banker the commission previously preferred, Gina Seller, had moved from Bank of New York to U.S. Bank, and that the commission had discussed switching trustees in prior meetings.

The commission also considered and approved two invoices for legal services that were presented at the meeting: one invoice to counsel described as $2,592 and a second for $288. A motion to approve the invoices was made, seconded, and approved at the meeting.

Other operational items discussed included potential economic development projects in the county (including sites near the LEAP District and requests from vendors tied to data-center suppliers) and scheduling changes: the commission agreed to shift meeting start times to 10 a.m. for upcoming meetings, with the next meeting date discussed as Sept. 18 or 19 in the discussion.

No formal public hearing or final policy decision on Whitestown payments was recorded in the meeting; staff said the commission will revisit the unpaid payment issue next month and sign the letters as directed.
