Derby council approves consent items, schedules executive session; street closure, storm sewer repair and Evergy encroachment included

At its Aug. 12 meeting the Derby City Council approved routine and consent items and recessed to an executive session later in the evening.
The council first approved the meeting agenda by voice vote (motion carried 8-0). During the public meeting the council approved the consent agenda, which staff described as containing four items, including minutes of the July 22, 2025 meeting and three operational items:
- A street-closure request for the Rotary Car Show makeup event on Saturday, Sept. 27, from 9 a.m. to 2 p.m., with the street-closure window from 7:30 a.m. to 3 p.m., closing East Walnut Street between North Georgia and North Derby Avenue; the event will be at the USD 260 Educational Support Center at 222 East Madison.
- A receive-and-file report recording emergency storm-sewer repairs adjacent to 111 North Brook Forest Road performed by NOWALT Construction in the amount of $37,970. Staff said the outfall failed in mid-July and the contractor performed repairs the week of July 22.
- An agreement with Evergy to allow sanitary sewer construction through a dedicated utility easement that overlaps an Evergy easement, requiring an encroachment agreement.
Council member Webster abstained from the street-closure vote because she serves on the Rotary committee and rotary board; other consent items were approved by the council and recorded in the minutes as passing 8-0 (with individual abstentions noted where applicable).
Later in the meeting the council recessed to an executive session "for consultation with the city attorney on matters which would be deemed privileged under the attorney-client relationship" pursuant to K.S.A. 75-4319(b)(2) to receive legal advice on potential liability and interpretation of state law. The council stated on the record that no binding action was taken in executive session, and the council adjourned after reconvening.
