Benton County planning commission adopts denial of Republic Services landfill expansion

At a continued public hearing, the Benton County Planning Commission adopted the final written decision denying Republic Services’ application (LU-24-027) for a conditional use permit to expand an existing landfill.

Chair Nicholas Fowler opened the meeting saying, “This is the time and place for the continued public hearing in the matter of LU-24-027, an application from Republic Services for a conditional use permit to expand an existing landfill,” and explained the purpose of the evening’s meeting was to adopt the Planning Commission’s written findings that support the commission’s July 22 decision to deny the application.

The commission spent the meeting reviewing and approving a series of staff-prepared findings and a set of commissioner-provided opening statements incorporated into the record. Commissioners debated whether certain sentences should be deleted, reworded, or clarified and voted on multiple technical corrections and wording changes before taking final action to adopt the decision.

Commissioners approved edits that included deleting a sentence that described a formal “weighing of evidence,” correcting a typographical code citation noted by Commissioner Fulford, replacing repeated uses of the word “experts” with “consultants,” changing phrasing that read as the commission “rejects” certain evidence to language stating the commission “considered” that evidence, removing a specific reference to “PFAS” in one paragraph so it now refers more broadly to “leachate,” and clarifying that Adair Rural Fire District is “largely composed of volunteers.”

Several commissioners expressed concern that adopting extensive rewording could reopen deliberations; counsel advised the body that limited technical and accuracy corrections were permissible but that reopening deliberations would risk the schedule and the appeals process. Commissioner Rosemary Osterholm moved to reopen deliberations; the motion failed for lack of a second.

After voting on individual corrections, Commissioner Wilson moved to adopt the Planning Commission’s written decision denying the conditional use permit as amended; Commissioner Fulford seconded. The final roll call vote recorded the following: Commissioner Bisco: aye; Commissioner Fulford: aye; Commissioner Struthers: aye; Commissioner Lee: aye; Commissioner Wilson: aye; Vice Chair Hamann: aye; Chair Fowler: aye. The motion carried and the planning commission’s written findings and conclusions became its final decision.

Chair Fowler read the appeals process included in the adopted decision: the Planning Commission’s decision may be appealed to the Benton County Board of Commissioners within 14 days of the Planning Commission’s final decision adopting the written findings of fact and conclusions of law. The hearing record notes the appeal fee is governed by Board Order 2023091 and requires a $5,000 deposit due from the appellant on filing.

Counsel Ryan confirmed that planning staff had tracked the technical corrections approved by the commission and that the revised, tracked document would be posted to the county website the following day.

The meeting concluded with administrative items: the chair announced the next Planning Commission meeting on August 19 and noted there is a vacancy on the commission and an interest form is available on the Benton County website. The hearing was then adjourned.

Proposed or potential appeals remain possible within the statutory 14-day window; staff and counsel said that the written findings as amended will form the official record for any further proceedings or appeals.
