Board: budget sign-off moves fee rulemaking forward; staff aim for Jan. 1, 2026 implementation

At a public meeting in Sacramento, staff reported that the budget office had approved the board’s fee rulemaking package, a key administrative step that will send the proposal next to the Department of Consumer Affairs (DCA) executive office and then the Office of Administrative Law (OAL).
The board’s regulatory counsel, DP Miller, told members that the rulemaking process involves several steps and that the fee package will be “noticed” after agency and OAL review. “We’re still hoping no later than July 1 next year, but it could still be by January 1 possible,” Miller said when asked about an implementation date.
The report credited budget staff for moving the package through the DCA budget review; staff named in the discussion included Angela (the board’s budget analyst) and Don, both of whom were thanked for their work. Staff said the package does not propose fees in excess of statutory maxima and described the remaining steps as routine but time-consuming.
Board members had no substantive questions after the update, and the chair opened the floor to public comment; none was offered. Staff said that, if all administrative approvals proceed, the earliest achievable effective date remains January 1, 2026, with a backstop of July 1, 2026 as written in the package.
No formal vote was taken on the rulemaking status report at the meeting; staff will return to the board with a formal regulatory notice and final language as the process proceeds.
