The Willard City Planning Commission on Aug. 7 took up a continued preliminary plan and subdivision improvement plan for the Mountain Bay Subdivision (approx. 8200 South Highway 89, parcel 010450133) after receiving an update that the applicant is re-evaluating options for sewer infrastructure.
Staff reported the applicant told the city earlier the same day that installing sewer dry lines is not financially possible under current proposals; as a result the developer is considering alternatives, including beginning development without sewer connections or pursuing disconnection from Willard and returning the property to county jurisdiction. Commissioners noted that any annexation or detachment requires formal city approval and that an applicant proposing annexation and a concurrent subdivision application should document in writing the obligations and conditions for development.
Commissioners expressed concern about starting development without sewer infrastructure and about long-term impacts on city services. One commissioner recommended that annexation approvals include a written agreement that clearly states the developer’s obligations for infrastructure and timing so the city will not be left bearing unexpected costs.
Staff said the item was continued; no final approvals or rejections were made. Commissioners asked staff to inform the city council; staff indicated a council work session on the question may be scheduled so council members can decide whether the city should pursue negotiation or impose specific annexation conditions.
No vote on the subdivision or an annexation change occurred during the meeting; the item will return for future review once the applicant provides updated options or documentation.
