Magistrate extends deadline for Fernandina Beach property owner to address unsafe structure; sets Oct. 3 compliance and $100 daily fine thereafter

A Nassau County special magistrate on Aug. 12, 2025, found that the property at 96179 O'Neil Scott Road in Fernandina Beach remains in violation of county nuisance and unsafe-structure codes and set a new compliance date of Oct. 3, 2025. If the property is not brought into compliance by Oct. 3, a $100-per-day fine will begin Oct. 4, 2025, and a fine-assessment hearing will be held Oct. 14, 2025.
Officer Marjie Camacho of Nassau County Code Enforcement told the magistrate that the case had been last heard July 8, 2025, and that an earlier order required compliance on or before Aug. 11, 2025. Camacho said she re-inspected the property on Aug. 5 and Aug. 11 and found continued noncompliance; during the Aug. 11 inspection the building department later verified a demolition permit had been issued but the county said the property still had not achieved full compliance. "As of today's date, the property has yet to achieve compliance with Nassau County code ordinance section 7-93," Camacho testified.
Property owner Charles James Baker Jr. spoke at the hearing and said he had attempted cleanup work but described logistical challenges, including utilities and equipment access. "I would have been in compliance, but I've had issues between getting my vehicles down... I tried to clean... I greatly appreciate the time, I'm trying," Baker said.
The magistrate continued the matter and preserved the $100 daily fine to begin Oct. 4 if the property remains noncompliant. The magistrate indicated a written order reflecting the announcement would be issued and recommended that Baker keep code enforcement apprised of cleanup efforts.
The county cited violations of Nassau County Code of Ordinances section 7-93 (unlawful residential, commercial and industrial building nuisances) and section 18.25-5. The hearing record includes demolition-permit documents and photographs from inspections; the building department earlier confirmed issuance of a demolition permit but inspections showed the property remained in violation as of the Aug. 11 reinspection.
