Commission backs zoning change to allow Sunday sales at marijuana facilities 10 a.m.–6 p.m.

The Garden City Planning Commission on July 10 voted to recommend that City Council amend the zoning ordinance to permit adult‑use marijuana facilities to operate on Sundays between 10 a.m. and 6 p.m. The motion passed by roll call.

Planner Ortega explained the draft text would remove the current prohibition on Sunday sales and replace it with an allowance for operations from 10 a.m. to 6 p.m. He said the police department provided a report of calls for service related to a facility that has been open about three months; Ortega characterized many entries in the department's log as false alarms and said the department did not make a specific recommendation for or against the change.

Douglas Stewart, who identified himself as representing the business at the location under discussion, told the commission the facility's alarm system is very sensitive and that false alarms have triggered police responses; he said there have been no break‑ins or other criminal incidents.

Commissioners discussed whether to allow longer hours (for example 10 a.m. to 9 p.m.) to match nearby competitors. One commissioner said the commission's earlier direction and prior council discussion had led staff to present 10 a.m.–6 p.m. as a measured change and recommended leaving the draft hours as presented for council consideration. A motion recommending the amendment as drafted — a zoning change that would apply to all marijuana facilities — passed and will be forwarded to City Council for final action.
