The adopted regulation removes a county‑population threshold from NAC language and defers membership and committee duties to the statutory requirements in NRS 388.385, consistent with federal Perkins requirements. NDE staff explained the change will harmonize NAC with statute and ensure districts of all sizes meet federal and state expectations.
2) Transition planning for students with disabilities — LCB file R058‑24 — Adopted The board adopted regulatory language to change the age at which IDEA transition planning must begin from 16 to 14. NDE staff and special education leaders explained the amendment aligns Nevada’s NAC language with several other states’ practice to start transition planning earlier to improve post‑school outcomes. NDE staff told the board the department has already added the 14‑year planning expectation into training and technical assistance for districts.
3) Residential treatment and education continuity (LCB file R131‑22) — No adoption; regulation pulled for further work The board opened and solicited public comment on proposed language (R131‑22) intended to define pre‑placement planning and monitoring for students placed in residential treatment facilities. Multiple stakeholders — county child welfare agencies, Clark and Washoe school districts, and legal aid organizations — provided written comments and requested additional stakeholder meetings to clarify responsibilities, information flow and monitoring obligations between courts, child welfare agencies, residential providers and school districts. NDE staff said the department will convene additional stakeholder sessions, revise draft language for clarity, and resubmit the proposal for LCB review. No adoption vote was taken on R131‑22; the regulation remains under development.
