Applicant seeks special exception to allow contractor shop and auto repair on Burke Lane property; staff supports eligibility
Summary
CBCAM LLC requested a Category 32 special exception to allow two commercial uses—contractor office/shop and an auto repair use—on a historically commercial property on Burke Lane. Staff said existing buildings, screening, and infrastructure support the request and proposed conditions limit employees, hours, and on-site operations.

County staff presented a request from CBCAM LLC to allow two commercial uses on a property at 7159 and 7185 Burke Lane (fronting James Madison Highway), asserting the property has a long history of commercial use dating to 1979 and is eligible under a 2024 zoning ordinance text amendment for historically commercial sites in RA (agriculture) zoning.
Staff said the property totals just over 6.5 acres and contains two existing commercial buildings and outdoor storage areas. The applicant proposes a contractor's office, shop and material storage yard at 7159 Burke Lane (approximately a 2,800-square-foot building and two one-acre storage yards) and an auto repair use in an approximately 8,500-square-foot four-bay garage at 7185 Burke Lane. Staff said each use would have up to 10 on-site employees, with combined on-site employees not to exceed 20; the applicant estimated between 2 and 4 deliveries and between 5 and 10 customer visits per day for each use.
Conditions outlined by staff would limit the uses to existing buildings and paved parking areas, require that materials and equipment be completely screened from view, prohibit vehicle storage outside paved parking, prohibit onsite manufacturing/processing/assembly and, for the auto repair use, prohibit auto body repair and painting and require installation of oil-water separators or mechanical exhaust systems before commencing use. Staff also noted the applicant requested a three-year establishment period rather than the one-year period otherwise permitted under zoning ordinance section 5014; staff said the board may approve a longer period as a condition of the special exception.
Staff concluded that given the long-term commercial use of the site, existing infrastructure, and screening, the property meets eligibility requirements and that property access and utilities appear adequate. No vote or final action was recorded in the transcript excerpt provided.
